Chapter One



Kate was smiling as Gibbs left the squad room with Corporal Yost. She was genuinely happy they had been able to get to the truth about his friend’s death. Well, Gibbs had done that, with a little help from someone he knew. It was nice to meet a flesh and blood gentleman who was truly honorable, even if he was old enough to be her grandfather. Kate knew too well how rare that was these days. Looking at Tony gave her a great example of how true that was. Sure, he could be serious if he had to, but never about women. McGee on the other hand…

Kate blinked. What was she thinking? That McGee was a gentleman? Working through her astonishment of thinking of him in the first place, Kate realized the truth in her thoughts. McGee was polite, kind, he didn’t kiss and tell and yet she sensed he could be forceful if the situation were to call for it.

Grinning to herself, Kate was pleasantly surprised that she may just work with a much younger version of Ernie Yost. Gathering her things, she turned off her desk lamp and told Tony goodnight. Barely looking at McGee, not wanting to give away her thoughts, she said, “Goodnight Tim.”

Closing her eyes in the elevator, she wondered what that slip of the tongue would cost her.

“Kate just called you Tim,” Tony commented, trying to get a rise out of McGee.

“It is my name, Tony. She calls you by your first name,” Tim pointed out, staying calm and finishing some paperwork.

“Yeah, but Kate and I have worked together longer. You haven’t been here that long. What would cause her to call you Tim?”

Tim gave up, “Why don’t you tell me, Tony, and then I could finish my work?”

Tony grinned. “Well, it can’t be because she is attracted to you. I mean, first of all, you’re you. Second, even if she were, there’s Gibbs’ Rule #12. So, Kate has to be tired.”

Shaking his head, Tim turned back to his computer. “Tony, we’re all tired. Why don’t you let me finish here, okay?”

“You need to go out, Probie,” Tony said not five minutes later.

Groaning, Tim protested. “I’m not going bar hopping with you Tony.”

Frowning, Tony looked at his co-worker. “I didn’t say anything about bar hopping, McGee. I said you need to go out. I don’t plan on taking you to many bars, just one small one I have in mind. Are you finished with that report yet?”

Sighing in frustration, knowing Tony wouldn’t shut up; he saved his report and determined to come in early tomorrow to finish it up. “Where are we going, Tony?”

“All right! That’s the spirit McGee! I’ll have you hooked up in no time.”

Tim followed Tony to the elevator and muttered, “That’s what I’m afraid of.”

“I’ve wanted to try this place out since it opened last year, but nobody seemed to want to go,” Abby told Kate as they sipped on their frozen margaritas.

“If I had known how good the margaritas were, I’d have been here months ago,” Kate laughed and licked some salt from the rim of her glass. “Oh no! What is Tony doing here?”

“Tony? Where?” Abby asked, maneuvering to see the door behind her. “Tim’s here too! How’d Tony manage that?” Abby looked back at Kate and saw their good time going down hill. “Want me to take care of Tony for you? I can guarantee he’ll leave you alone.”

Kate sighed in relief and nodded, “Please? He thought I had a date tonight. He doesn’t need to know why it was canceled.”

Abby grinned. “Don’t worry ‘bout a thing.”

“Abby! Kate!” Tony said, dragging McGee through the bar to them. “What are you two doing here? I thought you had a date?”

Abby took Tony’s arm. “Dance with me?”

Tony’s look of surprise turned into a grin. “Sure.”

Kate and McGee watched as the two found a place on the small, crowded dance floor. Ordering a beer, McGee took Abby’s seat.

“That gets Tony out of my hair,” he said and lifted his bottle to Kate.

Clinking her glass to his bottle, she grinned. “Mine too.”

McGee grinned back at her and Kate noticed how nice a smile he had. “What made you decide to come with him tonight?”

Tim stared at Kate, looking very pretty even in this dim light and shrugged. “It was a choice between coming here or not hearing the end of it for weeks.”

“I think you made the right choice.”

“Me too. What brings you and Abby here?”

“Abby wanted a night out and I didn’t want to spend the evening at home.”

“Tony said you had a date.” Tim watched her closely to read her expression when he brought that up.

“He had to cancel. Apparently, his partner didn’t appreciate him dating me,” Kate confessed.

Tim’s eyes widened. “He’s…”

“Involved in a serious relationship?” Kate finished his question. “Oh yes, very much so. Was I aware of it? No, and I should have been. Which explains why this is my third drink.”

Kate was surprised the McGee didn’t look like he pitied her and was relieved that he didn’t offer her platitudes.

A slow song came on, causing some of the patrons to filter off the dance floor, but Tim just stood. “Come dance with me,” he said, holding out his hand to Kate.

Hesitating wasn’t an option. Kate stood and placed her hand in his and they walked to the edge of the floor. As they swayed together, Kate felt herself relax and she put her head on his shoulder. Strange how it reminded her of her dance with Ernie Yost and yet was different too. Tim’s grip on her was sure, but not too tight. His hand was respectful on the small of her back, not dipping too low. Sighing, Kate closed her eyes and let Tim lead her on their small spot on the floor.

Chapter Two



“McGee, I need to talk to you,” Kate said.

Tony grinned. “Probie, you better start praying now. If Kate needs to talk to you, you’ll need it.”

Kate narrowed her eyes at Tony while saying, “Now, McGee!”

Tim gulped. Gibbs was out getting coffee, which meant he couldn’t stall this conversation by saying he needed to finish his search now. Reluctantly standing, he followed Kate to the elevator. As the doors shut, they heard Tony mutter, “When will we put cameras in those things?”

Tim stood tall in front of Kate. “If this is about that night at the bar…”

“I need your help Tim,” Kate interrupted.

His eyebrows shot up as his eyes questioned her.

“Don’t tell Tony, he’ll only joke about it. I signed up for a mentoring program, but I think I bit off more than I can chew.”

“Because of work?”

“Because she’s a female version of you.” Kate realized how badly that came out and said, “What I mean is, she likes computers more than people. She explained her reasons to me, which I have to admit makes sense. If there aren’t any viruses or glitches, you pretty much get out what you put in. People are more complicated. They rarely do what you think they will, especially with her background.”

“Sounds like a smart kid. How old is she?”

“Eleven. She sounds more adult than we do at times, Tim. She grew up too fast.”

“What can I do to help?”

“Teach me more about computers. Not how to use one, I know that. Teach me how to understand them.”

“Kate, I’m not sure what all you want to know, but I’m pretty sure one or two lessons won’t cover it.”

“I realize that. I told Penny that I wanted to understand her better and she suggested this.”

"Why won't she teach you?"

Kate laughed. “She said she didn’t think she had the patience.”

Tim smiled. “When do you want to start?”

“Today?”

Blinking, Tim mentally rearranged his schedule and nodded. “Today works.”

Kate started the elevator and smiled. “Thank you, Tim.”

Later that night, Kate was lying in bed wondering why people wanted to know so much about computers. All Tim had done was talk about all the inner components, showing her how they were assembled and she’d gone cross-eyed. Here, she’d been thinking she knew a lot about computers, when in truth, she barely scratched the surface. Closing tired eyes, she relaxed into her pillow and went to sleep.

Tim sat at his computer desk rubbing his temples. Kate was a smart woman and she understood a lot of what they’d talked about. He smiled, remembering how her eyes had glazed over a few times. But honestly, whose didn’t after he’d been talking computers for two hours? Pulling up Word, he opened a blank document. He’d set out a lesson plan and follow it. This would serve two purposes. One, Kate would know what to expect each lesson. Two, he would know when to stop so he didn’t overwhelm her. With a plan of action he felt good about, he typed quickly, not only planning but outlining each lesson to keep them both on track.

Penny opened the door of the group home and smiled at Kate. “Hi.”

Kate smiled at the young girl who was too slim for the blue jeans and long sleeve t-shirt she wore. “Hi Penny,” Kate replied. “Are you ready to go?”

Penny nodded and grabbed her backpack. When they were on the road, she asked, “Kate, do we really have to go shopping?”

Kate took her eyes off the road to study Penny’s face. “No, we don’t have to at all. What would you rather do?”

“There’s an exhibit today of post-impressionist art at the local college. Can we go there instead? I checked. There’s no charge to get in.”

“Of course we can,” Kate said and changed lanes to go to the school Penny named.

Penny’s smile was a reward to Kate. This was their third outing out of nine visits and that smile was the first genuine one she’d been given. They spent the afternoon going from painting to painting, discussing technique and each artist’s use of color and light, shadowing and brush strokes to create each different piece. Once again, Kate found herself surprised at the young girl’s understanding of the world around her. She realized that while computers were her number one thing, art might be a close second.

They opted for a sit down meal instead of fast food and the topic changed from art back to computers. Penny picked up on Kate’s new found knowledge and quizzed her until she got a confession.

“A friend of mine is teaching me.”

“What’s his name?” Penny asked.

Laughing, Kate questioned, “Why do you think it’s a guy?”

The look Penny gave her could have rivaled one from Gibbs. “Come on, Kate. First, I’m not stupid. Second, the way you smiled right before you told me. Third, you just said ‘a friend’. If he was a she, you would have said ‘my friend whatever-her-name is’.”

“Your powers of deduction are truly astounding,” Kate said.

“Don’t make fun. And don’t think I don’t realize you still haven’t told me his name,” Penny reminded her.

“I wasn’t making fun,” Kate told her, putting her napkin on the table. “His name is Tim and he’s been very patient with me.”

Penny nodded. “Tim’s a good name, and patience is important. Will I meet him?”

Caught off-guard, Kate asked, “You want to meet him?

“Of course! He’s teaching you pc so you can spend time with me without being bored stiff. I’d like to thank him for that.”

Kate thought it over and promised, “I’ll talk with Tim and let you know. That’s the best I can do.”

Grinning, Penny folded her napkin neatly. “It’s all I can ask for.”

Kate paid the check and drove back to the group home where Penny lived.

“I had a great time today, Kate.”

“So did I,” Kate replied as she hugged Penny goodbye.


Chapter Three



“Probie, this is sad, really. Three days in a row you’ve been in early and worked late. You really need to get a life,” Tony told him as he sat down at his desk.

“I’m happy with my life, Tony,” Tim said, not looking up.

Kate stepped off the elevator and walked to her desk, a small smile playing at her lips. Tony was about to pick on McGee's life again when he noticed how happy Kate was.

"Well, someone's happy. Big date last night?" he asked.

"No." Kate sat down and pulled the top file off the stack on her desk.

"Great night in?" Tony guessed again.

"No." Kate answered, showing more patience than normal.

Raising his eyebrow, Tony stood and walked to her. "No big date but you didn't stay in. Great sleepover, then?"

Kate's smile grew bigger right before Gibbs' hand connected with the back of Tony's head.

"DiNozzo, we have a case. Gas the truck and leave Kate alone." Gibbs tossed Tony the keys and smirked as he watched Tony grab his jacket and run to gas the truck.

"What's the case Gibbs?" Kate asked.

"An ensign found dead in the woods. LEO's saw the uniform and called it in."

McGee and Kate grabbed their things and followed Gibbs out to the truck.

At the scene, Tony was busy taking photos while Kate and McGee looked for evidence.

"McGee, I need to talk to you when we get off," Kate said quietly.

McGee looked up from bagging a shell casing and replied, "Sure."

Kate made her way over to Ducky and Palmer. Listening to the probable cause of death confirmed her suspicions. She started walking the perimeter of the crime scene and a dull black object caught her eye. Bending down, she reached out with one gloved hand and retrieved a .380 pistol. With her other hand, she shook out an evidence bag and carefully sealed the gun inside. Placing it in the box for handguns, she labeled it and signed off on it.

Ducky and Palmer were loading the ensign's body into their truck and Gibbs was rounding up the team. Kate's cell vibrated in her pocket and she looked at the display. It was a text from Penny that read, Have you asked yet?

Climbing into the seat, she sent a quick No back and put her phone away. She smiled again, thinking about Penny's request. Hoping Tim would agree, for Penny's sake of course, she was lost in thought when Tony nudged her.

"Deep thoughts, Kate?"

"Yes, Tony."

"About what?"

Knowing that Gibbs and Tim were listening to the exchange she replied, "The dead ensign. He had no defensive wounds, so he most likely knew his killer. He didn't have his ID on him, so he most likely thought they'd be going for a quick trip somewhere or the killer removed it. He was shot five times; none of them alone would have been deadly."

"Someone wanted him to suffer?" McGee asked.

Kate shook her head, "I honestly think the killer couldn't stomach killing him outright."

"Why do you think that?"

"The killer dumped the gun, then emptied their stomach on the ground ten feet away. They didn't police their brass or even try to collect any of the evidence."

"Could have been wiped clean," Gibbs pointed out.

Kate shook her head. "No, they would have covered the vomit if they were worried about that. Whoever killed the ensign didn't want the job."

By the end of the day, Kate's theory had been proven correct. The killer’s prints were on the gun and DNA was matched from saliva found in the vomit. Samantha Brooks was brought in and questioned. Faced with the evidence and her still guilty conscience, she confessed to killing Ensign Wally Hunter.

Sliding a pen and paper across the table to her, Gibbs asked, “Why?”

Samantha slowly reached out and picked up the pen. She paused before looking Gibbs straight in the eye. “I woke up three days ago with this on me,” she told him and revealed her right shoulder. Burned into her skin was a fleur-de-lis. “I don’t remember how I got it; I’m not a criminal like in some novel. There was a note taped to my bathroom mirror. It told me that if I killed Ensign Hunter, I’d be forgiven of my sins. I didn’t know what to do. I locked myself in my house until last night. I got a phone call asking if I’d paid my penance. The caller wouldn’t take no for an answer and said that one of us had to die, it was my choice which one. I was given instructions on where to find the gun and how to use it. I was told where he’d be. And I did what I was told.”

Gibbs left her to write her statement and found Kate in the observation room. Without asking her, Kate began, “Someone branded her, she has no idea how, and then sends her out to kill. Gibbs, everything she says seems to ring true. She has no criminal past. Someone wanted to use her to kill Wally Hunter.”

“Her phone?” Gibbs asked.

“McGee went to pull her records. She didn’t have caller id so she doesn’t know where the call came from or who made it. The phone company should know though. And we’ll find this person."

Gibbs turned and walked out.

By the time the case was truly wrapped up and the person behind the scenes was caught, Kate had received three more texts from Penny. Knowing she had to ask now, she cornered McGee by the stairs and just blurted it out.

“They are having a fundraiser for the group home where Penny lives. It’s a formal dinner/dancing evening and Penny suggested I ask you since she’d like to meet you and we’re friends.”

Tim’s shoulders straightened and his tired eyes brightened. “Penny wants to meet me and she wants me to go to this fundraiser?”

Kate nodded. “Yes to both.”

“It’s formal?”

“Yes.”

“Would I be going stag?”

Kate shook her head, “No silly, you’d be my date.”

Tim smiled for the first time that day. “Yes, I would love to go with you and I would love to meet Penny.”

Relieved, Kate hugged him quickly. “Thank you so much. It starts tomorrow at seven. Pick me up at six and we’ll go pick up Penny together. I’ll see you then, Tim.”

Standing like a deer in headlights, he watched her hop on the elevator and take off for the night. What had he just agreed to?


Chapter Four



Tim adjusted his bow tie once more and contemplated losing it until the moment Kate opened her door. Seeing her standing before him in a red silk dress, the long skirt barely hinting at the slit on the left side, he gulped. “Hello Kate.”

She smiled at him and he saw the angel that she could be when she wanted. “Hello Tim. Are you ready to meet Penny?”

Nodding, he stepped back to let Kate close and lock her door. Placing a hand at the small of her back, he escorted her to his car. He drove carefully to the house Kate directed him to and once again walked with her to the door, hand at her waist, allowing her to lead him slightly while keeping that small amount of contact. Penny opened the door without waiting for them to knock. She gave Tim a once-over and smiled. Holding out her hand, she said, “Hi, I’m Penny.”

Tim raised her hand to his lips and brushed a kiss over her knuckles, like an old-fashioned gentleman. She giggled and winked at Kate. He saw her coat and helped her with it. “Kate made me wear a dress for this.”

Laughing, Tim commented, “I think you made a lovely choice.”

Penny smiled happily and allowed him to lead her as well as Kate to the car. She was impressed with his manners and grinned at Kate while he was circling the car to get in. Kate shushed her with a hand motion but grinned at Penny’s reaction to the whole situation.

At the banquet, Kate explained that they had several major fundraisers a year to keep the group home going. Penny told Tim that while it wasn’t the best situation for all kids, it worked just fine for her and the people running it were very nice. Curious about her, Tim asked how Penny ended up there.

“My dad split when I was a baby. My mom decided she couldn’t take care of me and party, so she let the state take me. I got placed in the group home about two years after that and I’ve been there for five years.”

Surprised by her candor and her matter-of-fact nature of telling her story, he didn’t know what to say. Penny smiled at him then turned when another young girl called her name. She looked to Kate and Kate nodded her approval. She moved to join the group of young people away from the adults. Tim could see her looking their way and turned to Kate.

“She’s amazing. How does she not get angry over this?”

Kate was watching over the small crowd and told him, “Anger doesn’t change her situation Tim. It won’t bring her parents back to her and she wouldn’t want them back, not now. She’s learned that while anger can be the impetus to get you moving, it shouldn’t be your whole motivation.”

He raised his eyebrows and asked her, “Which one of you thought that up?”

Kate looked back at him and answered, “Penny told me that the first time we met. She told me if I was looking for an angry young girl to help through a crisis, that she wasn’t the child for me.”

Choking on his water, Tim put his glass down. “She said that?”

Kate nodded slowly. “Made me like her all the more, just in those first ten minutes.”

“It always shocks me when children are more adult than Tony,” Tim admitted.

Kate grinned. “Come on, Tim, babies can be more adult than Tony.”

He laughed and nodded his agreement as the band struck up across the room. After watching through several songs, he finally got his nerve up to ask Kate to dance with him. She said yes and he stood, taking her hand and leading her to the floor. For every slow song played, Tim would lead Kate into a simple waltz in a small section of the floor. At one point, he danced with Penny and watched as a young boy, maybe a year or two older than she was, turn red and get upset. Catching his eye, Tim made a small signal and the boy came over and asked to cut in. Bowing graciously, Tim retreated to their table and looked innocently at Kate in the face of her knowing grin.

“He likes her,” Tim shrugged when he couldn’t take her look anymore.

“I know. You did a nice thing out there, letting him interrupt. Penny likes him too; he just wouldn’t dance with her in front of his friends without a little motivation.”

“At least he’s polite,” Tim commented and nodded in the direction of some of the other boys.

“He could have gentleman potential,” Kate told him, “with the right influences.”

Standing as another slow song started, they moved to the dance floor and Tim took her in his arms. “Some people would say that the odds of finding a gentleman would one in a million.”

Kate laid her head on Tim’s shoulder and swayed to the music with him as she whispered, “Maybe.”
